General Terms & Conditions (“General Contest Rules”)
No one likes extensive rules and regulations, but you need to be aware of how it works so here are our General Terms & Conditions.
The General Contest Rules apply to all Create Consult Research and It’s My Station contests. Like all things, our General Contest Rules can be amended or varied by Create Consult Research ABN 93 606 213 450 (herein referred to as “CCR”) and It’s My Station ABN 24 202 488 727 ( herein referred to as “IMS”) and collectively referred to as IMS” “We”, “Our” or “us”).
We may also have times when specific Terms and Conditions may apply to particular contests, in that case we will let you know as they will be an addition to these General Contest Rules.

Prizes and Incentives
1.1: Prizes are non transferable and may not be redeemed for cash. If a prize has a specific use by date stipulated, it is the winner’s sole responsibility to abide by those terms.
(a) We will aim to have your prizes delivered to you within 6 weeks from the date of winning. CCR & IMS will are not in any way obligated to remind or notify winners of the valid time remaining on a prize. It will be the sole responsibility of winners to collect their prize. Should you fail to collect your prize, it will be treated in accordance with the current legislative requirements.
(b) If you choose not to accept a prize, you will forfeit any and all claims to that prize. It will be dealt with according to the absolute discretion of CCR and/or IMS in accordance with current legislative requirements.
(c) Winners are responsible for any and all taxes payable as a result of a prize being awarded or received and shall have no claim against CCR or IMS in respect to such payments.
(d) If the specified prize becomes unavailable, CCR or IMS may, subject to the legislation of the relevant State of the prize, provide to the winner a substitute a replacement prize at its absolute discretion.
(e) If we are required to send your prize to you, it will be sent to the address details you have provided to us . Furthermore, CCR and/or IMS accept no responsibility for the safety and/or overall postal delivery of the prize.
(f) All prizes are accepted entirely at the risk of the winner, and CCR and IMS shall not be liable or responsible for any or all warranties in connection with any prize to the extent permitted by law.
(g) In special situations, and subject to the absolute discretion of CCR and/or IMS , a winner may nominate a designated representative to receive a prize. The representative will be required to present written authorisation from the winner and produce photo identification which demonstrates to the satisfaction of CCR and/or IMS that he or she is the winner’s representative.
(h) All winners of all prizes must agree to these General Contest Rules and any CCR/IMS special contest Terms and Conditions, both in a form prescribed by CCR and IMS, in order to receive their prize.
(a) We may, at our own discretion, elect to offer an incentive for participating in market research project. In this instance the agreed incentive amount will stipulated and detailed to people who are recruited and confirmed to participate in a research project.
(b) We will only reward a person an incentive only after being identified as having fully completed the research project/s they were invited to participate in.
(c) A fully completed respondent will receive a payment email confirming the process within two week of a survey officially closing.
(d) Payment of the incentive will require the supply of Bank account information to allow direct deposit into a completed respondents personal Australian, New Zealand or Indonesian banking account. A respondent will access a Secured Layered page (SSL) to supply the requested information to allow a direct deposit transaction to be executed.
(d) In doing so, the completed respondent will be required to confirm their personal information held on file and confirm that the information they have provided is accurate.
(e) CCR and IMS will not be held liable for incorrect information supplied during this process.
(f) The provided Bank information for this incentive payment may be passed onto a Third Party to allow payment processing. We will advise who that party is at the point of payment processing requests and may include details of a contact person who may assist you.
(g) You are responsible for any and all taxes payable as a result of an incentive being awarded or received and no claim shall be made against CCR or IMS for such a payment.
(h) You must agree to these General Contest Rules and any CCR or IMS special contest Terms and Conditions both in a form prescribed by us in order to receive an incentive for fully completing a survey.
2.1 We, our agencies, affiliates, sponsors and representatives are not responsible for defective prizes or misuse of any prize, or for any claims, liability, loss or damage arising out of or in connection with any contest, survey or incentive promoted by CCR and IMS.
2.2 All contestants release and indemnify CCR and IMS against, all liability, cost, loss or expense arising out of acceptance of any prize(s), incentive or participation in any contest including (but not limited to) personal injury and damage to property and whether direct or consequential, foreseeable, due to some negligent act or omission or otherwise.
2.3 As required, winners will be directed to sign and endorse a copy of these General Contest Rules if requested by us.
2.4 To the extent that there is an inconsistency between the General Competition Rules and the Specific Competition Rules, the General Competition Rules prevail.
3: Entry & Eligibility:
3.1 All entries by internet are sent entirely at the risk of the entrant. If there are any difficulties encountered either with your internet connection or your equipment or device used to enter, we may at our absolute discretion disqualify the entire entry or any part thereof.
3.2: Unless otherwise specified in any additional special contest Terms and Conditions, no person may enter any contest more than once.
3.3 CCR and IMS may incorporate information from entrants in any contest(s) in any data base to be used for the purpose of its business.
3.4 Any person who enters a CCR/IMS Competition agrees to be bound by:
(a) the General Competition Rules; and
(b) the Specific Competition Rules.
(a) record and use the Personal Information for its own marketing, planning, product development, promotional and research purposes; and
(b) refuse to accept an entry which does not contain all or any of the Personal Information requested by us .
3.6 Any person may enter a CRR/IMS Competition, except for the following:
(a) a person who has previously submitted an entry in that particular CCR/IM Competition;
(b) an employee, officer, servant, agent or associate (as defined in section 9 of the Corporations Act) of CCR/IMS , or of its related bodies corporate (as defined in section 9 of the Corporations Act);
(c) a direct family member of a person referred. For this purpose a direct family member is taken to include a spouse, parent, child or sibling of that person);
(d) a person who is not ordinarily or usually resident in Australia, New Zealand or Indonesia; or
(e) a person who has refused to provide all or any of the Personal Information that may be requested by Us
3.7 We may extend the time for, vary or terminate any CCR/IMS Competition at any time in our absolute discretion. In the event of such termination, we may in our absolute discretion elect not to award any prize in respect of the terminated Competition.
3 Promotion and Publicity:
3.1 By entering a competition, you as competitor agree that you may be required to appear in publicity photos, film or video or audio content.
(a) You acknowledge that we has the right to use such publicity photos, videos, films or audio in any medium we see fit, unless you expressly advise us at the time of entering the relevant contest that you wish to retain anonymity.
(b) We may publicise, broadcast or otherwise disclose and promote a competitor’s name, character, likeness, statements or any recording of their voice in advertising or promotional activities concerning a specific contest, or any CCR/IMS contests generally.
(c) Contest entries and material submitted in connection with any contest (online, electronic, written, audio, or visual form, or any combination of), any photographs, video and/or film footage and/or audio recording taken of competitors; will become the property of CCR/IMS. Copyright of such material will become and remains the property of CCR/IMS.
4.1 All terms and conditions shall be governed by and construed in accordance with the law for the time being in force in the Commonwealth of Australia. All parties hereby submit to the non-exclusive jurisdiction of the courts of the Commonwealth.
